1.1 This advertisers agreement ("the Agreement") is made between Dez Res ("Dez Res", "We") and the Advertiser ("You).1.2 By entering into this agreement you are confirming you have read these Terms and Conditions and agree to them.
1.3 You agree to Dez Res publishing your advert details on our web site and the web sites of our partners — if any.
2. YOUR RESPONSIBILITIES
2.1 You have the legal right to sell or rent the property.2.2 The description you supply is true and accurate and not misleading. Dez Res, its Staff or Agent's will not be held liable or responsible for the accuracy of the information supplied.
2.3 You will pay the full advert fee before the advert will be published.
2.4 You have obtained permission from the owner of any photographs used in the advert. Dez Res, its Staff or Agent's will not be held liable or responsible for breach of copyright.
2.5 If you have a contract with an Estate Agent, you have independently checked your contract with regards to the terms and conditions that you must pay the Estate Agents commission. If later it is found that you are legally bound to pay the Estate Agents commission, Dez Res, its Staff or Agent's will not be held liable or responsible.
2.6 Only one property is allowed.
2.7 You will assemble the 'For Sale by Owner Board' complying with the local planning authority regulations.
2.8 You will dispose of the 'For Sale by Owner Board' after its use by either returning it by post to us at your own expense, or dispose of it in accordance with your local authority regulations.
2.9 Once your property is sold you must remove any For Sale board within 14 days of its sale.
2.10 You will set your own selling price or rental price.
2.11 You will arrange and conduct viewings for the advertised property.
2.12 You will inform Dez Res once the advertised property is sold or rented.
2.13 The property advertised must be private residence and not a commercial residence.
2.14 As the 'responsible person' for marketing your property, you will be responsible for ordering and supplying your own Home Information Pack.
2.15 You are wholly responsible for the accuracy (images, description, asking price etc.) of your listing (see our layout instructions, here). You are free to update your listing as often as you see fit. Dez Res are here only to advise or resize images if requested.
2.16 For an additional fee of £10.00; payable in advance and non refundable, we will upload your property details and its photographs to your listing but remember, Dez Res, its Staff or Agent's will not be held liable or responsible for their accuracy.
3. DEZ RES' RESPONSIBILITY
3.1 Once your free trial period comes to an end and you have purchased either the six month or 12 month advertising package, we will endeavour to supply you with our For Sale by Owner Board within 5 working days (postal disputes permitting).3.2 We will re-advertise your property on our partner websites — if any — within 5 working days. Publication on partner sites maybe subject to alteration or cancellation according to changes in service imposed on us by those partner sites. As such we cannot guarantee unlimited publication on these sites.
3.3 Services that fall under the until sold option will be reviewed after a year has passed from the date the service was purchased. After which Dez Res will have the right to discontinue the advert which includes the re-advertising on partner sites — if any.
3.4 Services that fall under the until let option have purchased a slot for 1 year from the date of purchase, after which the advert will expire which includes the re-advertising on partner sites — if any.
3.5 We will, to the best of our efforts, ensure that the Dez Res web site is available at all times. We reserve the right to take the site 'off-line' without prior notice for essential maintenance and upgrades.
3.6 Dez-Res does not and will not hold any credit/debit card information that you supply to PayPal. PayPal handles all transactions via their secure server on our behalf.
3.7 For an additional fee of £10.00; payable in advance and non refundable, we will upload your property details and its photographs to your listing but remember, Dez Res, its Staff or Agent's will not be held liable or responsible for their accuracy.
4. PROPERTY IMAGES
4.1 You are allowed ten [10] property images.4.2 Each image must not exceed 75k in size (400 Pixels Wide x 300 Pixels High @ 72 dpi).
4.3 Image extensions allowed, .jpeg and .jpg.
5. DISCLAIMERS
5.1 Information about Dez Res and any Dez Res Affiliates that is posted on this Web Site has been extracted from publicly available data about Dez Res and the relevant Dez Res Affiliates, as applicable. If sent by regular post, it will be effective 3 days after posting by Dez Res.
7. GENERAL
7.1 Dez Res reserves the right to add to or change the terms of these Advertising Terms in its sole discretion without your prior consent. All changes to the Advertising Terms will be effective once posted on the Web Site. Dez Res will provide notice on the Web Site of any changes to the Advertising Terms for 30 days after Dez Res has posted the amended Advertising Terms on the Web Site. Your continued use of the Web Site or any of Dez Res's services available on the Web Site following Dez Res's posting of such changes will be regarded by Dez Res as acceptance of the amended Advertising Terms. If you do not agree to be bound by the amended Advertising Terms you should exit the Web Site and not access or use any of Dez Res's services on the Web Site in the future.7.2 No variation or amendment to these Advertising Terms by you is valid unless otherwise agreed by Dez Res in writing and signed by a duly authorised representative of Dez Res and you.
